Order.
On the reading and filing of the complaint of Margaret Roy Janet Mackay and it appearing therefrom that the said Margaret Roy Janet Mackay is unlawfully restrained of her liberty at the United States detention station at Seattle, Washington, by Henry M. White, commissioner of labor of the United States, acting under the pretended authority
of a warrant of arrest and deportation issued by the secretary
of labor of the United States wherein it is charged that the said
complainant is an alien and that she at the time of her entry was
a person who believed in the destruction of property and the overthrow
of the government, and that a hearing was held to inquire
into the merits of said charges and that a complete copy of the
testimony taken at such a hearing, together with the exhibits attached
to such testimony is now in the possession of the said Henry
M.White and ought to be produced on the hearing of the above
entitled matter in order that the court may have the best evidence
available on the issues tendered in the complaint herein.
NOW, THEREFORE, IT IS ORDERED that Henry M.White, commissioner
of labor of the United States stationed at Seattle, Washington,
before me on the 3rd day of February, 1919, at 2 o'clock in the
afternoon, then and there show cause, if any he has, why the said Margaret Roy Janet Mackay be further restrained of her liberty and why
a writ of habeas corpus should not issue herein as in the complaint
prayed, and
IT IS FURTHER ORERED that the deportation of the complainant or her removal from the United States detention station at Seattle, Washington, be stayed until the further order of this court.
