W.C. Jones being first duly sworn deposes and says: That he is the prosecuting attorney for said county district

That Joseph Bradshaw is a material and necessary witness on the part of the plaintiff in the above entitled action without whence plaintiff cannot safely proceed to trial of said action. That defendant is informed and believes that said Joseph Bradhsaw is now confined in the county jail of County Washington Territory under sentence for a criminal offense.

Affiant further says that this affidavit is made for the purpose of procurring a writ of Habeas Corpus to present the body of said Joseph Bradshaw to be produced in court on the trial of said action to give testimony   therein
