I Thomas C. Griffitts, being first duly sworn on my oath say: I just prepared the accompanying draft of affidavit for Wm. Bigham in his presence and according to the facts as stated to me by him and read the affidavit or draft of affidavit to him and he informed me that the statements therein were true in fact and that he would make the affidavit if the prosecuting attorney said he would and with the said draft of affidavit and returned it to affiant in [?] declined making the affidavit by advice. That affiant believes the advice referred to is the advice of the prosecuting attorney and that but for such advice the affiant named have been true made affiant further states that he is informed and believs that the matters and things set forth in said   affidavit which is hereto annexed and made part hereof marked "a" actions and within the knowledge of the prosecuting attorney.
