Ray Raymond deft } Charge Murder

On this June 26th 1886 W.D. Gillespie makes and files complaint charging defendant with having on the 26th day of June 1886 in the City of Spokane Falls Spokane County Washington Territory purposely and of her deliberate and premeditated Malice Kill James Finch, by shooting him in the neck With a pistol, and demands that she be arrested and dealt with according to law

Warrant issued and placed in the hands of W.D. Gillespie specially appointed by this court to serve same there being no qualified Officer in this precinct at this time. Subpoena issued for Pearl Worthington, Ruby Stanley, W Bonner, Dr. Morgan, J.H Huschka, Joseph Bradshaw, John Maibes on the part of of the Territory and placed in the hands of W.D. Gillespie special officer for serving

June 26th 1886 Warrant rerturned by special officer he certifying in his return   that he executed the same by arresting defendant and having her in his custody and does not bring her into court by reason of an agreement between the prosecuting Attorney S.C. Hyde Esq and Attorney for defendant T.C. Griffits Esq that on account of her sickness she need not be brought into court pending her application for a continuance

Certificate and affidavit of physician A.J. Cambell M.D. taken and filed said affidavit setting forth that she is under Medical treatment by him for nervous prostration and is unable at this time to be removed from her bed wihtout greatly endangering her condition. Prisoner remanded to the custody of said officer with instruction to safely keep and deliver prisoner into court at 4 O'Clock P.M. this day or at any time thereafter if she is still not able to attend at said 7 O'Clock

Continued to 7 O'Clock P.M. this day

At 7:15 O'Clock P.M. appearing from prosecution S.C. Hyde Esqand for defendant F.C. Griffits Esq the officer in charge of the prisoner reporting that she is still so prostrated that she cannot safely be brought into court, By Consent in open court this case is continued to Tuesday June 29th 1886 at 10 O'Clock A.M. and officer charged to safely keep said prisoner and witness informed that they must hold themselves subject to the order of the court

 

June 28th 1886 Subpoena issued on the part of the defendant for John Maibus, Mose, Ruby Stanley, Pearl Worthington, M.R. Kellinger, H. Summers and A.C. Edwards & also on the part of the defendant for James Barnes, G Palentay Frankie Snitzinger, and Joe Howard and placed in the hands of S. B. Leininger Constable for sevice

June 29th 1886 at 10:15 A.M. Subpoena for plantiff for Jas Bradshaw et al returned srved and filed, Court open Prisoner in Court appearing for prosecution S.C. Hyde Esq and for defendant Messrs Griffits and Stouh Attorney for prosecution moves to discharge Pearl Worthington and Ruby Stanley as witnesses on the part of the prosecution objected to be defts Counsel. Objection overruled and motion granted and said witness discharged. Defendant and defendants counsel expressly waiv[?] the formal reading of the complaint by the court Subpoena issued on the part of the defendant for Jos Bradshaw W.D. Gillespie Jno Maibies Pearl Worthington Ruby Stanley, W Bonner, Dr Morgan and JH Huschka and placed in the hands of S.B Lenninger Constable for service

Jno I Booge Esq Justice of the Peace for Spokane County W.T. associated by invitation to assist this court in the execution of the powers and duties in conducting this   examination and said Jno I Booge by agreement of this combined court is duly appointed to take down in writing the testimony produced in this court on this exammation

At 12 O'Clock M. Continued to 1 O'Clock P.M. Witnesses placed under order if the Court and prisoner remanded to the custody of the officer

Subpoena issued on the part of the defendant for Dr. C.J. Penfield and on order in his hands taken from the body of James Finch deceased and placed in the hands of S.B. Leininger Constable for service

June 29th 1886 1 O'Clock P.M. Court convened, Subpoena part of Territory for Pearl Worthington et al returned served and filed Prisoner and Counsel presented Subpoena on part of defendant for James Barnes et al returned served and filed Subpoena on the part of the defendant for Dr Morgan et al returned served and filed also Subpoena for Dr CJ Penfield on part of defendant returned served and filed. At 6 O'Clock P.M. case continued to June 30th 1886 at the hour of 10 OClock A.M witness placed under the order of the court and prisoner remanded to the custody of the Officer

June 30th 1886 Court met present prisoner, and Counsel on both sides examination proceded with, Adjourned at [12 M] to 1:30 O'Clock P.M. at 1:30 P.M prisoner and Counsel all present examination proceded   with, to 6 Oclock P.M. Adjourned to July 1st at 10 O'Clock A.M

July 1st 1886 At 10 O'Clock AM Court convened Present prisoner, and Counsel for both sides. Examination proceeded with At 12 M Adjourned to 1 O'Clock P.M. At 1 O'Clock PM. conveened, Present prisoner and counsel, subpoenas on the part of the Territory one for Selliger and Crane and one for Penfield Hanna and Boyd returned served and filed Subpoenas on the part of the defendant for one for Thomas Jefferson and one for John Mabius et al returned served and filed

At 6 O'Clock P.M adjourned to 7:30 PM At 7:30 PM Court coveened Present Counsel and proceeded to close with argument and same being completed this court takes this case under advisement till 1 O'Clock PM July 2nd 1886

July 2nd 1886, the following witnesses then sworn and examined in this case on the part of the plaintiff W.D. Gillespie Jas Huschka, Jas Bradshaw, JM Morgan, JM Mabius, C.S. Penfield JH Boyd, JC Hanna on the part of defendant JB Barnes, F Snitzinger, Ruby Stanley, Thomas Jefferson,

 

This court after hearing the testimony and deliberating on the same and having considered the law and the evidence find that the offense as charged in the complaint filed in this case has been committed and that there is probable cause for charging the defendant Ray Raymond with the crime of Murder in the first degree and that the proof is evident and the presumption great that the said defendant is guilty of said crime

It is therefore ordered that the dedendant be committed to the country jail of Spokane county withtout bail to answer at the next term of the district court of the 4th Judicial district holding terms at the county seat of Spokane County to answer to the said charge of Murder in the first degree and that the witnesses for the prosecution be required each to recognize in the sum of Two Hundred dollars to appear at said court to testify in this case
