IN THE MATTER OF THE APPLICATION OF MRS. GLADYS FREDRIKA FUSON, FOR A WRIT OF HABEAS CORPUS. }

NO. 3451 RETURN OF RESPONDENT

Comes now King Dykeman, individually and as judge of the Superior Court of King County, State of Washington, and makes return to the writ of habeas corpus issued herein, on the 36th day of October, 1916, and says;

I.

That repondent denies all the allegations contained in the petition of Gladys Fredrika Fuson, and specifically denies that the said petitioner is confined in any prison or jail, and specifically denies that said petitioner is in the custody or control of the respondent; and respondent futher shows to this court that said petitioner is confined in the Juvenile Detention Home of King County, State of Washington, of which one Dr. Lilburn Merrill is in charge; that said home is provided by the public authorities of King County, a municipal corporation of the State of Washington, for the detention and protection of delinquent and dependent children, as defined by the laws of the State of Washington; that in the Superior Court of the State of Washington, for the County of King, on the 24th day of October, 1916, there was filed a petition, an exact copy of which is attached hereto and marked Exhibit A, and by reference thereto made a part of this return

That respondent denies all the allegations contained in that petition of the juvenile division of the Superior Court of the State   of Washington for King County, the said petitioner appeared by P.H. Wilson, her attorney, and asked that said cause be heard and determined by another judge of the Superior Court of the State of Washington for King County.

III.

That respondent after hearing testimony and being fully advised in the premises, and pending the final deposition of said cause by another judge of the Superior Court of the State of Washington, for King County, did make and enter an order, a copy of which is attached to this return, marked Exhibit B and by reference thereto made a part hereof, which order was filed in the Superior Court of the State of Washington, on the 25th day of October, 1916.

IV.

That the petition marked Exhibit A has never been finally disposed of by the Superior Court off the State of Washington and the said petitioner is being detained in the Juvenile Detention Home of King County, Washington, pending the final determination of said petition.

NO. 4385 DELINQUENCY PETITION

Your petitioner Blanche H. Mason a reputable person and resident of said County, respectfully represents unto your Honor that Gladys Hauck-Fusen a girl born on or about September 8, 1899 now being within said County, is a delinquent child, in this, that since her marriage to Harold W. Fusen, during July, 1916, she has deserted him and has lived at Port Townsend and Seattle, Washington, and in both communities she has consorted illicitly with objectionable companions; and she is without parental care and control (her father being dead and the whereabouts of her mother, Frederika McDonald, being unknown) and she is in need of the care and protection of the Court

Therefore your petitioner prays this Honorable court to inquire into the alleged delinquency of said child, and into the truth of the matters herein contained, in pursuance of the Statute in such cases made and provided; and to make such orders in the premises as this Honorable Court may deem advisable in the interest of the said child

EXHIBIT B.

IN THE SUPERIOR COURT OF THE STATE OF WASHINGTON FOR THE COUNTY OF KING

JUVENILE COURT

IN THE WELFARE OF GLADYS HAUCK-FUSEN Delinquent}

NO. 4385 ORDER MAKING WARD OF COURT AND AUTHORIZING DETENTION.

Now, on this 25th day of October, 1916, this matter coming on regularly for hearing upon petition of Blanche H. Mason in behalf of Gladys Hauck-Fusen, a child; the Court after hearing the evidence and being fully advised in the premises finds that the said Gladys Hauck-Fusen is a delinquent child whithin the meaning of the law; and it appearing to the Court that her father is dead, and the whereabouts of her mother, Frederika McDonald, are unknown, and that the said child has been living about the community of Seattle without parental care and control and under social conditions which jeopardize her moral welfare;

IT IS THEREFORE ORDERED by the Court that the said Gladys Hauck-Fusen be and remain a ward of the Court; and

IT IS FURTHER ORDERED that she remain in the custody of the County Detention Home subject to the further order of the Court.
