In re Frankie Switzinger for writ of Habeas Corpus. Commitment

 

United States of America Territory of Washington County of Spokane} In Justice's Court before J. J. L. Peel J.P.

The City of Spokane Falls
vs.
Frankie Sutsinger deft.

To the city marshall of Spokane Falls or any Constable and the keeper of the County jail of said County,

Whereas, at the Justices court, held at my office in the City of Spokane Falls, in said county and Territory, for the trial of Frankie Switsinger for the offense thereinafter stated, the said Frankie Switsinger was convicted on trial (refusing to plead) on the testimony of witnesses under oath, for the offense of wilfully, unlawfully and maliciously, keeping a house, within the city limits, of the city of Spokane Falls, in which other persons, smoke or inhale opium, contrary to the provisions, and in violation of an ordinance of said city, entitled "an ordinance prohibiting the smoking or inhaling of opium", passed by the city council September 9th 1885, and upon said testimony[?] the said court did adjudge and determine that the said Frankie Switsinger should pay a fine of Twenty five dollars, and the costs of said action[?], amounting to Twenty nine and 65/100 dollars, making a total of Fifty Four and 65/100 dollars, and said Frankie Switsinger having failed to pay said fine and costs, you the said marshall or constable are commanded in

 

the name of the United States forthwith to convey the said Frankie Switsinger to the keeper of the county jail at Cheney, said county and territory, and you the said keeper are hereby commanded to receive the said Frankie Switsinger into your custody, in said jail, and be there safely keep, until she shall then be discharged, by due course of law.
