Sterling P. White v. John Cody. Verdict

Jan. 5th 1885

In the matter of Territory versus S.P. White said S.P. White was arrested on a warrant issued by the coroner upon a verdict of said Coroners Jury which commenced on 25th day of Dec. 1884. S.P. White for plaintiff defendant and at the request of the undersigned J.H. Friedlander assisted in trying said case counsel for defendant ask for a continuance on the grounds that he was not a lawyer and had no time to get one. The justice decided that it was not a sufficient excuse as there elapsed 15 days and that said 15 days was time sufficient. defendant then waived an examination on the same grounds not granted then filed an afidavit for a change of venue no cause being shown the trial concluded and justice claimed that he had no jurisdiction only as a committing magistrate.

The following witness were duly sworn and examined viz: H. Portch, E. A. Portch, S. T. Beardon, John Jump, Frank Beardon, O. J. Rodgers, R. C. Welch G.M. Sherman, N. R. Williams and Wm Rhodes. The evidence being all in the testimony of the court is that said S. P. White is guilty of the offence of causing the death of A. L. Beardon and it therefore commits him to jail to await the action of the Grand jury.
