James Riley v. Egbert H. Tucker. Testimony

Robert White being first duly sworn says on Sunday morning the 18 inst went to Montgomerys in company with H E Bradley J.W. Riley, [?] within some time. When he returned to Mr Bradleys house was in company with Walmsley, even a crowd rush out of Bradleys house, seen Mr. Riley jump off a fence in the rim of the house. he ran toward the house. At the end of the house he seized McLeod & both went out of deponents sight for about 20 yard. I then seen Riley draw his hand with a stone in it, but could not see distinctly where he struck. then I seen him strike McLeod with the stone about two more. Riley then went into the house & left McLeod lying on the ground. he was lying on the ground when Riley struck him would know the stone (stone produced and identified) Riley afterwards stated that he had killed McLeod & threatened to kill Walmsley when Riley caught hold of McLeod (he caught McLeod by the hair of his head. Riley & McLeod got out of deponants sight when Riley first seized McLeod in came gain[?] of a fense between them & deponant. all this occured in Pierce County W.T.
