Alexander S Hughes David Hughes James Boyd David Hart and Joseph Brannan

Defendants except to Sheriff return and say that notwithstanding he claims to hold them under said commitment the same is illegal.

For that these defendants never threatened to destroy to injure and destroy the property of of Josiah Gellerson and Geroge Gellerson as in any way on the 5th day of May or at any other time upon which they were convicted and upon which said commitment was issued
