With the death of his wife, and his prescribed medical leave, Jay Allen left his 17-month-old son, Jay Allen Jr., under the care of his father, and Jr.’s grandfather, John H. Allen. On January 25, 1902, John H. Allen would file a petition for Habeas Corpus for his grandson, whom he claimed was detained by the Lynch household (Simon Lynch, his wife Jane Doe Lynch, and Mable Lynch) without legal cause. Judge Boyd J. Tallman accepted the writ, the fate of which remains unknown.
