Case Summary

Edward F. Hunter filed a writ of Habeas on behalf of Mary Josephine Marshall on account of Mary being a minor. Hunter claimed that Edward Deggeller was appointed guardian of Mary by H. S. Elliot and to place her in the Good Shepherd's Home. Hunter further claimed that this confinement of Mary is illegal and that Mary should be released. The writ was granted. It was found at the following court proceedings that Mary had run away from home, refusing to live in the same house as her mother, Mary Cook, and her stepfather, H. J. Cook. Mary Josephine Marshall went to Eliza Robinson for housing, and Robinson initiated proceedings in the Lewis County Superior Court to become her legal guardian. The court ruled Robinson unfit, and assigned Edward Deggeller as her guardian, and Deggeller placed her in the care of the House of the Good Shepherd until she came of age. Further documentation from Mary Cook granted her consent for Mary Josephine Marshall’s placement there. As a result, Mary Josephine Marshall was left in the care of the House of the Good Shepherd.
