Alberto Sichofsky was found to feloniously and knowingly enter and attempt to the United States from a foreign country, in this case, the Republic of Mexico. Sichofsky came to the Republic of Mexico from Poland, where he was a male citizen of the age of sixteen years and over. Sichofsky was then imprisoned at McNeil Island prison, from which he petitioned for a writ of Habeas Corpus on the basis that he had completed his sentence of three years after credit for good conduct and therefore was being unlawfully deprived of his liberty. Judge Neterer found that Sichofsy was indeed unlawfully detained and ordered for his release from McNeil prison.
