Yuzuoka Mutsu, the petitioner, petitioned for a writ of Habeas Corpus after she was detained by Ellis DeBruler, Commissioner of immigration in Seattle, Washington. Mutsu was detained with Nakagawa Hatsu in August of 1910; both women were detained and charged with practicing prostitution subsequent to entry to the United States. In the petition, Mutsu is identified as a resident of Washington, an inhabitant of the state for the past nine years, and a subject of the Japanese Empire. Her petition made the argument that her confinement was in violation of the United States Consititue and Treaty of the United States with the Japanese Empire, specifically in relation to the sections pertaining to discrimination because she was not given equal protection under the law. Judge Donworth denied the writ and ordered Mutsu to be remanded to the custody of DeBruler.
