Case Summary

On August 13, 1862, Marion Fair petitioned for a writ of habeas corpus. Justice of the Peace W. P. Horton ordered that Fair be put in jail for grand larceny. Fair was imprisoned by Walla Wall County Sheriff James Buckley. Fair insisted that there was no evidence to convict him of the crime. Judge Oliphant ordered him released, but also decided that Fair had to pay court costs.
