Case Summary

On June 19th, 1913, Albert H. Young and Kamasaburo Sugiuor petitioned for and received and order allowing a writ of Habeas Corpus having been in a county jail awaiting trial under the custody of Joseph R. H. Jacoby. Young and Sugiuor had been arrested and indicted by a grand jury in 1921 for violation of the White Slave Traffic Act for the violation itself and the conspiring of committing the offense. They were placed on trial in February of 1913 and charged for the offense in May of the same year where they were committed to jail and had been since. In their petition they presented that as they were in jail upon awaiting trial upon the indictment, they were being twice put in jeopardy for the same offense in violation of the fifth amendment of the U.S. Constitution. Jacoby in his response presented that the petition did not state facts to cause action against him. It was July 1913 when the court sustained Jacoby's response and ruled the petition be dismissed. The fate of the two petitioners is unknown.
