Charles and Mary Marino were arrested for the unlawful sale and possession of intoxicating liquor. On July 3, 1924, Charles was sentenced to nine months in the Lincoln County Jail along with a $400 fine. On December 1, 1924, Charles petitioned for a writ of habeas corpus and argued that he served each of the three-month sentences concurrently and should be discharged. On December 3, the judge ordered the respondents to release Charles from custody. The respondents appealed the case to the U.S. Court of Appeals Eighth Circuit (St. Paul, Minnesota) on March 14, 1925. On January 30, 1926, the decision of the lower court was reversed by the higher court and the judge remanded Charles to the custody of the respondents. The higher court also referred to the decision in the Cronin v. William J. Fox case.
