Case Summary

On November 15, 1922, J. H. Walker filed for habeas on behalf of Luis Digilo, against Chief of Detectives, Charles Van Duesen, Chief of Police, Michael Dempsey, and City Commissioner, Henry Dunn. In the petition, Walker explained that Digilo was being held without warrant under the suspicion of being a fugitive from Justice in the state of Iowa. Walker further argued that Digilo had not been in Iowa at the time of the alleged offense and that the respondents had threatened to kidnap Digilo and bring him outside court jurisdictions. On the return of the writ, the respondents argued to be holding Digilo, since November 9, under the authority of a telegram received from Sheriff of Polk County, Iowa, W. F. Robb. A writ was issued but the case was dismissed for want of prosecution on January 21, 1924.
