Case Summary

Yellow Sun, Little Wolf, Horse Driver, and Blue Hawk petitioned for a writ of Habeas Corpus and Judge George Lake released them on bail of six thousand dollars. With this agreement Yellow Sun et al. must later then appear in the District Court for Lancaster County. Interested parties, Eagle Chief and Tera-cowah acknowledged themselves as indebted to the State of Nebraska for five thousand dollars. Then, Samuel M. Janney and Jacob M. Troth also acknowledged themselves indebted in the same manner, but for the sum of one thousand dollars. This allowed for all of the petitioners to be released as long as they returned to Lancaster for further proceedings in October. Lastly, in October of 1971, Judge Lake released them without bail and struck the case, with the provision that if new evidence is available within 28 months they will be tried again. After 28 months passes they were truly free from proceedings.
