In the District Court of the Third Judicial District of Washington Territory holding terms at Seattle.

In the Matter of the application of C.A. Clayton et. al for a writ of Habeas Corpus etc.

Upon reading the petition of the petitioners in the above entitiled cause for a writ of Habeas corpus and being acquainted in the premises and being unable to enquire in to the and both parties agreeing hereto in open court it is now CO N S I D ERE D and O R D E R E D and that a writ of Habeas Corpus issue to the said J.E. howland master of the said ship Kate Davenport, commanding him to produce before the Honorable J.P. Hoyt Judge of the district court of the second judicial district of W.T. at Olympia Thurston County the Bodies of C.A. Clayton Geo. Rosenthal, Wm. Lewis John Mc. Donald Chas. Olsen Chas Kales Fredericke Linde and C. Roschman on the eleventh day of October at the hour of three p.m. o that there and then the said Judge may investigate and hear and determine whether the said petitioners are improperly restrained of their liberty as alleged and it is further ordered that the clerk of the above named court do issue the said writ returnable aforesaid and place the same in the hands of the proper officer for execution.
